  China & Taiwan Implement Mutual Recognition of Priority Rights

  Since ECFA and the cross-strait IPR agreement were signed in September, many have wondered when the established goals and frameworks would become reality. Since many political, administrative and even logistical issues had yet to discussed, many were surprised when on 11 November 2010, China's State Intellectual Property Office of China (SIPO) and Taiwan's Intellectual Property Office (TIPO) announced the implementation of mutual priority rights recognition for patents and trademarks.

  TIPO to Cut Patent Backlog in Half by 2015, Reduce Pendency to 24 Months
 

As in many patent offices around the world, the Taiwan Intellectual Property Office has had trouble coping with the rapid increase in invention patent applications. From 1999 to 2009, applications have more than doubled and as of September 2010, 149,862 invention applications were pending, with an average time to final decision being 40.7 months.

To significantly improve review capacity, the Executive Yuan approved in June the "Patent Backlog Clearing Project". The project involves hiring 97 researchers (from the pool of national service candidates) to assist in patent searches, 39 full-time TIPO Staff, 170 5-year contract examiners, and other programs to increase examiner review capability. refunds for withdrawn applications, itemize application and examination charges, expanded references to include foreign patents search and examination results and other measures. These efforts have increased the number of applications an examiner reviews from 67 in 2008 to 105 in 2010. At the current rate, TIPO estimates that the backlog will be reduced to 74,946 in 2015, with average pendency dropping to 24 months or lower. TIPO’s press release can be found here.

  TIPO and Italian Patent Office (UIBM) Sign MOU
  On 4 November 2010, TIPO director Wang Meihua and Italian Patent & Trademark Office director Avvo. Loredana Gulino signed a Memorandum of Understanding (MOU) to promote enhanced cooperation between the two offices. Italy is the fourth European Country, after France, Spain and the Czech Republic to sign an MOU with Taiwan. The MOU includes frameworks for visits, exchange of best-practices, experience and information exchange, and organization of seminars and activities that will promote closer interaction and exchange between the two countries.

  Annual China Patent Applications Reach 1 Million

  According to official statistics, the annual number of patent application at the State Intellectual Property Office of China (SIPO) has reached 1 million for the first time. On 18 November, the 1,000,925th application was filed. The applications can be divided into three types: invention patent applications reached 323,266 (32.3%), utility model patent applications reached 337,658 (33.7%) and design patents reached 340,000 (34%).
