PTAB issues updates to the Trial Practice Guide

Today, the PTAB issued updates to the Trial Practice Guide to indicate that the Board will hold a pre-hearing conference fifteen days prior to an AIA oral hearing in cases instituted under the process implemented on October 17, 2025. Parties in other cases may request a pre-hearing conference by emailing Trials@uspto.gov.

EPO offices closed from 24 December 2025 to 1 January 2026

This means that all time limits for filing documents and making payments that expire between 24 December 2025, and 1 January 2026 will be extended until 2 January 2026 (Rule 134(1) EPC). For PCT procedures, this applies mutatis mutandis (Rule 80.5 PCT). You can, however, continue to submit documents to the EPO during this period, preferably online via MyEPO services.

PTAB data availability ending in Developer Hub and replaced by Open Data Portal

Effective January 6, 2026, Patent Trial and Appeal Board (PTAB) datasets in Developer Hub will no longer be available. Our Open Data Portal will now be the source for PTAB data and available through APIs for searching and bulk downloads. The Unitary Patent has seen an exceptional uptake among European users since its inception. Unitary Patents spare users considerable time and money. With a single right, users automatically gain patent protection in 18 EU Member States, with cost savings of around €26 000 in renewal fees for the average 12-year term of a patent compared to classic European patents validated separately in each state.
